Terms of Use

These Terms of Use (“Terms”) govern your use of housefixteam.com (the “Site”) and the services offered through it (together, the “Services”) by House Fix Team (“House Fix Team,” “we,” “us,” or “our”). By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. What we do

House Fix Team connects homeowners with service professionals in our network for home repair, maintenance, and improvement projects. When you submit a request, our customer service team reviews it, contacts you, and matches you with a professional who serves your area.

Unless we tell you otherwise in writing, the service professional you are matched with is responsible for the work they perform, including its quote, quality, scheduling, permits, licensing, and insurance. Any agreement for the work is between you and that professional.

2. Eligibility

You must be at least 18 years old, and able to enter into a binding contract, to use the Services. You must be the owner or authorized occupant of the property, or be authorized to request work on it.

3. Information you provide

You agree to give accurate, current, and complete information, and to submit requests only for yourself. You may not submit another person’s name, phone number, email address, or property details without their permission. The phone number you provide must be one that you own or are authorized to use.

4. Communications

By submitting a request, you agree that House Fix Team and the service professional matched to your project may contact you about it. If you give the consent described in our TCPA Notice, this includes calls from our customer service team and text messages to the number you provided. Your consent is not a condition of any purchase. You can opt out at any time as described in that notice.

5. No guarantees

We work to match you with qualified professionals, but we do not guarantee that a professional will be available in your area or for your project. We also do not guarantee any particular price, schedule, or result. Availability shown on the Site is an estimate and may change.

6. Acceptable use

You agree not to:

• Use the Services for any unlawful, fraudulent, or harmful purpose;
• Submit false, misleading, or automated requests;
• Interfere with or disrupt the Site, or try to gain unauthorized access to any part of it;
• Scrape, copy, or collect content or data from the Site by automated means without our written permission;
• Impersonate any person or misrepresent your affiliation with any person or company.

7. Intellectual property

The Site and its content, including text, graphics, logos, and software, belong to House Fix Team or its licensors and are protected by law. You may view the Site for your own personal, non-commercial use. You may not copy, modify, distribute, or create derivative works from the Site without our written permission.

8. Disclaimer of warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, HOUSE FIX TEAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOUSE FIX TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some states do not allow these limitations, so they may not all apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless House Fix Team and its owners, employees, and agents from any claims, losses, and expenses, including reasonable attorneys’ fees, that arise from your violation of these Terms or your misuse of the Services.

11. Governing law and disputes

These Terms are governed by the laws of the State of [], without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Services will be brought in the state or federal courts located in [], unless applicable law requires otherwise.

12. Changes to the Services and these Terms

If any provision of these Terms is found unenforceable, the remaining provisions will stay in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy and TCPA Notice, are the entire agreement between you and House Fix Team about the Services.
